نبذة من الكتاب :



1- الدفع باعتبار الدعوى غير موجودة لعدم تجديدها من الشطب خلال ثلاثة أشهر غير معتبر من الدفوع المتعلقة بالنظام العام وبالتالي عدم جواز إثارته من المحكمة من تلقاء نفسها.

2- الاستئناف ناقل الدعوى بحالتها قبل صدور الحكم المستأنف في حدود ما هو مرفوع في الإستئناف وبالتالي عدم جواز التحدي أمام محكمة النقض بدفاع غير مطروح سابقا أمام محكمة الموضوع أو مطروح أمام محكمة أول درجة ومتنازل عنه أمام محكمة الدرجة الثانية.



1- The plea that the action shall be deemed null and void for the non-suit renewal within three months is not related to common law pleas, and therefore the court shall not raise it of its own accord.

2- The appeal refers the action as is before the appellate judgment is rendered within the limits of appeal, and therefore any plea that was not presented before the trial court, or presented before the court of first instance and abandoned before the superior court, shall not be raised before the court of cassation.
